Employment Laws In China

China has its own distinctive labor policy, and it is important for foreigners to grasp the essential laws in order to guarantee that their legal rights are not infringed, and that they do not get fines or be arrested while working in the country.

Upon completion of the following article, you will have a basic grasp of the laws or visa requirements as well as the guidelines for working and living in China:

1. The labor contract shall be signed within one month of the start date.

If your employer does not sign a labor contract with you within one month, you should be compensated with double your monthly wage.

2. The probationary or trial period should not be more than six months.

According to the terms of the work contract, there are three sorts of situations that might occur:

More than a month but less than a year is considered to be: a period of no more than one month

1 year but less than 3 years: 1 year but less than 3 years: no more than 2 months is allowed

Three years or longer: for no longer than six months

3. The pension/endowment insurance policy must be in force for a minimum of 15 years.

Your pension after retirement will be reduced if you do not pay your pension insurance premiums on a consistent basis.

4. Medical insurance premiums must be paid within three months of the policy being issued.

Alternatively, you will no longer be covered by this insurance.

5. The time limit for filing an unemployment insurance claim cannot exceed 24 months.

It may be classified into three categories based on the amount of time that has accrued since the last payment:

In less than a year's time: Within 12 months, you will be eligible for unemployment insurance benefits.

In less than 10 years, but not less than 5, Within 18 months, you will be eligible for unemployment compensation.

More than ten years: obtain unemployment insurance payments within 24 months after being unemployed.

6. The average weekly working duration does not exceed 44 hours on a weekly basis

Employees are required to work no more than 8 hours per day and no more than 44 hours per week on average.

7. The total number of hours of overtime each month cannot exceed 36 hours.

Workers are entitled to at least one day off per week and are not permitted to work more than three hours per day or more than 36 hours per month in overtime.

8. The time limit for identifying and rescuing workers injured on the job is 48 hours.

Employees who are suspended from work due to job-related illnesses or occupational diseases will be paid their original monthly income and will continue to be eligible for the same benefits they were previously eligible for. The suspension period, on the other hand, shall not exceed 12 months.
